Public Law

Emily regularly represents local authorities, parents, children and intervenors in care and adoption proceedings up to and including multi-day final hearings and findings of fact. To date proceedings she has acted in have involved issues including: domestic violence; sexual abuse; child abduction; child sexual exploitation; physical abuse; parental mental health issues and non-accidental injury. Emily often represents parents with significant cognitive and learning difficulties.

Emily has advised local authorities and parents on international adoption mechanisms and procedure.

Private Law

Emily represents parents, intervenors and the children via a rule 16.4 Guardian in private law proceedings up to and including findings of fact hearings and multi-day final hearings. Emily regularly acts in proceedings where parental alienation is an issue in the case.

Contested Divorce & Nullity Proceedings

Emily is developing a practice in contested divorce and nullity proceedings which often involve an international element, jurisdictional issues or the applicability of other law such as Sharia Law.

Notable Cases

• Re JA (2020) – Care proceedings involving the representation of a client with a significant cognitive impairment that was masked by social skills. Successfully sought an amended LA final care plan which changed from a care order with placement outside of the home to a supervision order and rehabilitation to the client’s care.
• C v C (2021) – Contested nullity proceedings involving consideration of provisions of the Gambian Marriage and Divorce Act
• Re M Children (2021) – Final hearing in care proceedings representing a client with significant mental health difficulties. The proceedings involved cross examination of the expert as to the impact of cultural experiences and identity on mental health.
• Re W Children (2021) – Finding of fact hearing in proceedings involving alleged non-accidental injury and parental substance misuse. Successfully argued that the Local Authority ought to make an application to withdraw on the morning of the first day due to lack of evidence.
