Tom Gilbart Successfully Resists Appeal in EAT

Acting on behalf of both claimants in the case, Tom Gilbart has successfully resisted an appeal to the EAT in a case involving the question of a how a ‘Place of Work’ should be defined.

The EAT refused to allow the employer’s appeal against a finding that they had unfairly dismissed the two claimants.

Mr Gilbart had also conducted the case when it appeared at first instance – when the employer was also found to have discriminated against the claimants on the basis of disability and association with a disabled person.
