Richard Selwyn Sharpe acted for the executors in the application by Miles Taylor a music student and natural son of the deceased businessman Peter Gardiner to vary the consent order made in 2008 for periodical payments under the Inheritance (Provision for Family and Dependants) Act 1975 to provide for payments totalling a further £21,500 to go towards his maintenance for the next three years including two years at post graduate music college. The claimant had originally claimed payments of over £90,000. The sum awarded was ordered to be kept in a seperate bank account by the executors and the executors’ costs awarded on an indemnity basis out of the estate.
