Brian McCluggage appears in important High Court authority in McHugh (Deceased) v Esure [2017] EWHC 710 (QB) which determined liability issues in a sensitive case arising out of a fatal accident. The High Court considered the following matters:

  • The operation of ex turpi causa in a road traffic accident during the commission of a crime
  • The evidential status of criminal convictions in civil proceedings
  • Significant reduction for contributory negligence in circumstances where the Deceased was intoxicated and involved in an incident of ‘road rage’.
