Julie-Anne Luck proves allegation of neglect against Wrightington, Wigan and Leigh NHS Foundation

Nine St John Street barrister Julie-Anne Luck represented the parents of a deceased baby girl at the Inquest into her death at the Royal Albert Edward Infirmary, Wigan. She was instructed on behalf of the bereaved family by Daniel Comerford of Co-Operative Legal Services.

The Coroner noted “There was a culture within the neonatal unit that if a baby did not require active nursing tasks then the baby could be left unattended for short periods of time even if they had been assessed as needing constant nursing observations.”

He found there was a gross failure on the part of the Paediatric Registrar to provide basic medical care to the baby after the discovery of the bleed, which was causative of her death. She suffered hypovolemic shock due to severe haemorrhage from the umbilical cord stump – in other words the baby bled to death. The Coroner found that neglect by the Registrar, contributed to the baby’s death.

Additionally the Coroner found that there were failings in the provision of care to the baby’s mother during pregnancy.

Julie-Anne continues to represent the parents in their clinical negligence claim against the Trust for damages. Daniel and Julie-Anne have a proven track record of working together on such sad cases.
