Nine Chambers is pleased to share that Martin Mensah appeared in Zinda v Ark Schools & National Education Union [2026] EWHC 469 (KB), heard before Deputy Master Skinner KC in the High Court (King’s Bench Division) in December 2025.
Martin acted directly for the Second Defendant, the National Education Union, in proceedings brought by the Claimant seeking to set aside two earlier judgments on the grounds that they had been obtained by fraud.
Martin successfully argued that the applications against the NEU should be dismissed. The Court found that the evidence relied upon by the Claimant was not new – it had been in his possession at the time of both original judgements – and that there was no basis for a finding of conscious and deliberate dishonesty by either Defendant. The claims were struck out as having no prospect of success and certified as totally without merit. The claim against the NEU was struck out on the Court’s own initiative, having accepted the arguments Martin advanced. The matter was referred to a High Court Judge to consider whether a further civil restraint order is appropriate.
