James Fryer-Spedding has acted for the successful defendants in Martin v Wilkinson [2025] EWHC 3575 (Ch), a High Court claim concerning the ownership of company shares.
The case considered whether shares in a long-established property investment company formed part of the deceased’s estate or were held on trust for family members. The Court found that a valid trust had been created through the deceased’s words and conduct, despite there being no formal trust deed.
The judgment followed a complex, long-running dispute that went to trial. James was instructed by Johnny Coulthard, Partner at Burnetts Solicitors.
