Joanne Woodward succeeds in defeating a complaint of indirect discrimination against the UK Departments of Health

Joanne Woodward successfully represented the four UK Departments of Health in a case of indirect discrimination brought by a medical student studying at six-year medical degree in Prague. The claimant had been refused entry on the UK Foundation Programme, a two-year training programme for medical students as she was eligible for full registration with the GMC. The Central London Employment Tribunal rejected the claim as, although it accepted that the eligibility criterion put non-British medical students at a disadvantage when compared with British medical students, the Tribunal found that the eligibility criterion was capable of justification.
